Acceptable Use Policy
Version 2026-10-13 · Last updated: October 13, 2026
MadHatter is an independent project. It is not affiliated with, endorsed by, or connected to ByteDance/Seedance, Google, OpenAI, or any other model provider. These documents are provided for general information only and do not constitute legal advice.
This Acceptable Use Policy (“AUP”) applies to everything you create, upload, generate or share with MadHatter, whether in the studio or through the API, MCP server or CLI. It forms part of our Terms of Service. We built MadHatter for creative work, and these rules keep it safe, lawful and trustworthy. Breaking them can lead to content removal, feature restrictions, suspension or termination of your account and, where the law requires, reports to the authorities. The model providers behind MadHatter have their own usage policies too; where they are stricter, their rules also apply.
1. Absolute Prohibitions (Zero Tolerance)
These lead to immediate termination and, where applicable, reports to law enforcement and child-safety authorities:
- Child safety. Any sexual, sexualised, exploitative or abusive depiction of minors — real, fictional, stylised or AI-generated — including attempts to generate it, grooming, or content based on a real minor’s face, likeness or voice.
- Non-consensual intimate imagery (NCII). Creating or sharing intimate or sexually explicit imagery of any real person without their explicit consent, including “nudifying” or sexualising images of real people. Victims can request removal as described in Terms §8.3; we act on valid reports within 48 hours.
- Terrorism and violent extremism. Content that promotes, glorifies, incites or supports terrorism or violent extremist organisations.
2. Real People, Likeness and Deepfakes
- Do not upload or generate content using the image, likeness or voice of a real, identifiable person without their consent. When you upload a photo, video or audio of someone else, you confirm you have their permission.
- Do not impersonate any person or organisation, or misrepresent your affiliation.
- Synthetic-media disclosure: if an Output realistically depicts a real person, or could reasonably be mistaken for real footage of people, places or events, clearly disclose that it is AI-generated when you share it, in line with Article 50 of the EU AI Act.
- Do not remove, hide or alter AI labels, watermarks or provenance metadata on Outputs, or present Outputs as made without AI.
- Do not use the Service or Outputs for facial recognition, biometric identification or verification, or surveillance of individuals, or to infer sensitive traits (such as health, ethnicity, religion or sexual orientation) about real people.
3. Deception, Misinformation and Elections
- Do not create or share content intended to deceive, defraud or scam.
- Do not generate false content presented as fact in ways likely to cause harm, including fake emergencies, invented statements by real people, or manipulated depictions of real events.
- Do not create content designed to interfere with elections or democratic processes, including fake political endorsements, fabricated ballots or voting misinformation.
4. Sexual Content
- No pornographic or sexually explicit content.
- No sexual content involving minors under any circumstances (see Section 1).
- Artistic, medical or educational nudity may be allowed within in-product guidelines, but never of real identifiable people without consent and never involving minors.
5. Violence, Hate and Harassment
- No content that incites, glorifies or threatens violence against people or animals, or gives instructions for serious harm (weapons of mass destruction, explosives and the like).
- No gratuitous gore (such as realistic dismemberment or torture) outside clearly fictional or artistic contexts allowed by in-product guidelines.
- No hate content: content that dehumanises, demeans or promotes discrimination or violence against people based on race, ethnicity, national origin, religion, disability, disease, age, sexual orientation, sex, gender or gender identity, including hate symbols and hateful stereotypes.
- No harassment, bullying, threats, doxxing or defamation.
- No content that promotes self-harm, suicide or eating disorders.
6. Intellectual Property and Other People’s Privacy
- Do not upload Inputs or use Outputs in ways that infringe copyright, trademark, design, personality or privacy rights. You are responsible for having the rights to everything you upload.
- Do not deliberately generate content that reproduces copyrighted characters, artworks or logos, or that imitates the distinctive style of an identifiable living artist for commercial exploitation without permission.
- Do not upload other people’s personal data (including biometric or health data) without a lawful basis, and do not put sensitive personal data in prompts.
Rights holders can report infringement via our notice-and-action procedure (hello@madhatter.technology); affected users can appeal removals within 6 months (see Terms of Service §12). Repeat infringers will be terminated.
7. Illegal and Regulated Uses
- No use of the Service for illegal activity, or to promote illegal products or services.
- Do not present Outputs as professional advice (medical, legal, financial) or use the Service to give such advice, including interpreting medical results.
- Do not use Outputs to make fully automated decisions with legal or similarly significant effects on people, or in law enforcement, immigration or the administration of justice.
- No use in high-risk settings where failure could cause death, injury or severe damage (such as critical infrastructure, medical devices or weapons systems).
8. Platform Integrity
- No scraping, crawling, bulk downloading, or automated mass generation beyond documented API limits.
- Do not use the Service or its Outputs to develop, train, fine-tune, distil or evaluate competing AI models.
- No reverse engineering, model or prompt extraction, prompt-injection or jailbreak attempts, malware, or circumvention of usage limits, safety filters or moderation.
- No account sharing, multiple accounts to get around limits or repeat trial offers, resale of access, spam, or fake engagement.
- Do not abuse automatic credit refunds, for example by deliberately submitting prompts you expect to be blocked.
9. Enforcement and Appeals
- We use automated systems and human review to detect violations. Automated filters may block prompts or generations; you can report a wrongful block in the product or at hello@madhatter.technology.
- Depending on severity and history, enforcement ranges from content removal and warnings to feature restrictions, suspension or termination. Except in zero-tolerance and legally required cases, we will tell you which rule was broken and why (a statement of reasons) and give you a chance to respond.
- Appeals: you can appeal any enforcement decision within 6 months via hello@madhatter.technology. A person who was not involved in the original decision reviews it. This complaint-handling system follows the EU Digital Services Act.
- We report child sexual abuse material and imminent threats to life to the competent authorities.
10. Reporting
Anyone can report content or behaviour that breaks this AUP at hello@madhatter.technology. We prioritise reports of illegal content, intimate images and child-safety issues. Reports from “trusted flaggers” under the DSA receive priority handling.
